Bike Tool Library Membership Agreement
Borrowers Agreement and Tool Use Policy
1. Members must be aged 18 or over to borrow bike tools from Lochaber Environmental Group.
2. Prior to borrowing tools, Members must (a) agree to our Borrowers Agreement and Tool Use Policy; (b) sign the Waiver Form; (c) provide membership details and proof of identity (valid photo ID and proof of address).
3. Personal data will be held in accordance with our data protection policy.
4. By taking possession of an item, the Member is confirming that they are capable of using that item in a safe and proper manner. Lochaber Environmental Group accepts no responsibility for demonstrating usage.
5. Only the Member is authorised to use Lochaber Environmental Group’s tools. The Member shall not permit the use of items borrowed by him/her by any other person unless by the express permission of staff of Lochaber Environmental Group
6. All tools borrowed are to be returned to Lochaber Environmental Group by close of business on the agreed due date. Tools can only be returned during opening hours.
7. If a tool is returned late, the Member may be responsible for a late fee. The late fee will be £5 per week. Late fees must be paid in full before borrowing further tools.
8. Lochaber Environmental Group may replace severely damaged tools, holding the Member responsible for the full replacement cost of the tool. Damage charges must be paid in full before borrowing further tools. The charge will be no more than the cost price of the tool if bought new.
9. Lochaber Environmental Group reserves the right to use appropriate steps to retrieve damaged tools or unpaid charges and fees. Lochaber Environmental Group also reserves the right to waive fees due to special circumstances.
10. Tools may be reserved by contacting Lochaber Environmental Group. All reservations must be confirmed by a Lochaber Environmental Group staff member, volunteer, or automated response to be effective.
11. The Member agrees that Lochaber Environmental Group is not responsible for any manufacturing defects in quality of workmanship or materials inherent in any borrowed tools.
12. The Member agrees that if any borrowed tool becomes unsafe or in a state of disrepair, he/she must immediately discontinue use of the tool and notify Lochaber Environmental Group of the issue on return, if not earlier.
13. All tools are to be returned in the same (or better) condition as they were issued, barring normal wear and tear. The Member agrees to pay for the loss of or damage to any item and further agrees to accept Lochaber Environmental Group’s assessment of condition of items. The Member agrees to the assessment by Lochaber Environmental Group of fair restitution for damage and/or loss of items in part or in total. The restitution amount could equal the full replacement cost of the item.
14. All tools must be returned clean.
15. Lochaber Environmental Group reserves the right to refuse the loan of any item at its discretion.
16. The member must present a valid photo ID when they collect tools or the loan may be refused.
Liability Waiver
The tools in our collection are for the use of Lochaber Environmental Group bike tool library members. As per the Borrowers agreement and Tool Use Policy, tool borrowers are responsible for any damage they cause.
As a member, I agree to the following:
1. I am capable of using the tools I am borrowing, I know how to use them, and I will use the tools in a proper manner.
2. I will use whatever protective equipment is appropriate for the tools I am borrowing.
3. I do hereby for myself, on behalf of my successors and assigns, in consideration of being permitted to borrow tools, waive any and all claims against Lochaber Environmental Group, its Board, employees and volunteers for any injury or injuries of any nature that I may suffer or incur in the use of the tools that I am borrowing from Lochaber Environmental Group.
4. I hereby for myself, on behalf of my successors and assigns, in consideration of being permitted to borrow tools, agree to release and indemnify and hold harmless Lochaber Environmental Group, its Board, employees and volunteers any and all liability, loss, claims, and demands, actions or causes of action for the death or injury to any persons and for any property damage suffered or incurred by any person which arises or may arise or be occasioned in any way from the use of tools I am borrowing from Lochaber Environmental Group.
5. I am aware Lochaber Environmental Group, its partners, directors, employees, members, and volunteers claim no expertise and make no representation concerning the fitness of any tool for any particular use.
6. I confirm that the membership information provided to Lochaber Environmental Group is current, true and correct and consent to any verification deemed necessary.
